3. Scope of Services

We offer the following services:
• Health Services: Tools and resources for personal health analysis and optimization.
• Training and Education: Courses, seminars, and certifications on heart rate variability (HRV) and related topics.
• Hardware Sales and Rental: Devices for HRV analysis, including recorders and chest belts.

All services are designed to promote autonomous and responsible health management. Medical diagnoses or treatments are not provided.

4. Eligibility

To use our services, you must:
• Be at least 16 years old.
• Provide accurate and up-to-date personal information during registration.
• Comply with these Terms and applicable laws.

5. Registration and Accounts

• Account Creation: Users must register to access our analysis portal and services.
• Account Responsibility: Users are responsible for maintaining the confidentiality of their login credentials and for all activities conducted under their accounts.
• Account Restrictions: Private accounts are for individual use only. Sharing access or uploading data from other individuals may result in account suspension.

6. Right of Withdrawal for Consumers

6.1 Eligibility

If you are a consumer under the Austrian Consumer Protection Act, you have the right to withdraw from your contract within 14 days without providing a reason.

6.2 Exceptions

This right does not apply to:
• Opened or used hardware (e.g., chest straps).
• Software that has already been activated or used.

6.3 Withdrawal Process

To exercise your right of withdrawal:
1. Notify us in writing via email or post within the withdrawal period.
2. Return any unused hardware in its original packaging.

7. Usage of the Analysis Portal

7.1 Access and License

Registered users are granted a non-transferable, non-exclusive license to access our analysis portal and related services for the duration of their subscription.

7.2 User Responsibilities

• Ensure the accuracy of personal data. • Use the platform solely for its intended purpose. • Comply with copyright and intellectual property regulations.

7.3 Availability

We strive to maintain a 98% annual uptime. Planned maintenance and technical issues beyond our control may result in temporary service interruptions.

8. HRV Training and Certification

• Participation in training is voluntary and at your own risk.
• Fees are non-refundable if cancellation occurs within four weeks of the event.
• Certificates are issued upon successful completion of training modules.

9. Pricing and Payments

• All prices include applicable VAT unless otherwise stated.
• Payments must be made in advance via the provided payment methods.
• Failure to pay may result in service suspension.

10. Intellectual Property

All content, materials, and trademarks, including Autonom Health ® and Lebensfeuer ®, are protected by copyright and trademark laws. Unauthorized use, distribution, or reproduction is prohibited.

11. Data Protection

We are committed to protecting your personal data in accordance with GDPR and Austrian data protection laws. For detailed information, please refer to our Privacy Policy.

12. Liability

• General: We are not liable for any damages arising from incorrect usage of our products or services.
• Service Disruptions: We are not responsible for interruptions caused by external factors or force majeure.
• Limitations: Liability is limited to intentional or grossly negligent damages.

13. Termination

13.1 Termination by Users

Users may terminate their subscription by providing 7 days’ written notice before the end of the billing cycle. Unused fees are non-refundable.

13.2 Termination by Provider

We reserve the right to terminate accounts or services due to violations of these Terms or applicable laws.

14. Governing Law and Jurisdiction

These Terms are governed by Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Any disputes will be resolved in the competent court in 3400 Klosterneuburg, Austria.

15. Amendments

We reserve the right to amend these Terms. Users will be notified of changes, and continued use of our services constitutes acceptance of the updated Terms.
